PART I – GENERAL TERMS AND CONDITIONS

§ 1 Basic Provisions

(1) The following terms and conditions apply to contracts concluded with us as provider (Muhammed Dogan Dogac, trading as "Limited Breed") via the website www.limitedbreed.com. Unless otherwise agreed, any terms and conditions used by you are hereby rejected.

(2) A consumer within the meaning of these terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

A trader is any natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their trade, business or profession.

§ 2 Formation of Contract

(1) The subject matter of the contract is the sale of goods.

(2) By listing a product on our website, we make you a binding offer to conclude a contract via the online shopping cart system on the terms stated in the product description.

(3) The contract is concluded via the online shopping cart system as follows:

The goods you wish to purchase are placed in the shopping cart. You can access and modify the cart at any time.
After clicking "Checkout" or "Proceed to Order" and entering your personal details, payment and delivery information, the order summary will be displayed.
If you use an instant payment system (e.g. PayPal, Klarna), you may be redirected to the provider's website to complete payment, after which the order summary is shown.
Before placing your order, you can review, correct or cancel your details.

By clicking the order button ("Buy now", "Order with obligation to pay" or similar), you make a legally binding acceptance of the offer, thereby concluding the contract.

(4) Order processing and all related information will be sent by email, partly automated. Please ensure your email address is correct and that you can receive emails.

§ 3 Right of Retention, Retention of Title

(1) You may only exercise a right of retention in respect of claims arising from the same contractual relationship.

(2) The goods remain our property until full payment of the purchase price.

(3) For traders, the following additionally applies:

We retain title to the goods until all outstanding claims from the ongoing business relationship are settled.
You may resell goods in the ordinary course of business; the resulting claims are hereby assigned to us up to the invoice amount.
In the event of combination or mixing, we acquire co-ownership proportional to the invoice value.
Securities will be released if the realisable value exceeds 110% of the claims.

§ 4 Statutory Warranty Rights

(1) Statutory liability for defects applies.

(2) Consumers are asked to inspect goods upon delivery for completeness, obvious defects and transport damage. Failure to do so does not affect statutory rights.

(3) Deviations are only agreed if expressly communicated before the conclusion of the contract.

(4) For traders:

Our own product description is authoritative.
Warranty at our discretion by repair or replacement.
Warranty period: 1 year from delivery.
Excluded are damages from injury to life, body or health, and intentional or grossly negligent breaches of duty.

§ 5 Right of Withdrawal

Withdrawal Policy

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party named by you (other than the carrier) took possession of the goods. In the case of multiple goods ordered in one order and delivered separately, the period begins on the day of receipt of the last item.

How to Exercise Your Right of Withdrawal

You may use the electronic withdrawal function available directly on our website (accessible via the "Withdraw from Contract" button in the footer). This is the quickest and most convenient way to submit your withdrawal. Upon submission, you will receive an automatic confirmation email.

You may also inform us of your decision to withdraw by means of a clear statement (e.g. a letter sent by post or an email). To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction. You will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Electronic Withdrawal Function (§ 356a BGB)

In accordance with § 356a BGB and EU Directive 2023/2673, we provide an electronic withdrawal function on our website. You can find the "Withdraw from Contract" button in the footer of our website. The function is available without login, at all times during the withdrawal period. Upon submission, you will immediately receive an automatic confirmation email with a timestamp.

Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

Goods made to the consumer's specifications or clearly personalised.
Sealed goods not suitable for return due to health/hygiene reasons and unsealed after delivery.
Goods which after delivery are inseparably mixed with other items.

§ 6 Prices and Payment

(1) All prices are total prices inclusive of applicable taxes.
(2) Delivery is free of charge.
(3) We accept Shopify Payments, Klarna and PayPal.
(4) Payment is due immediately upon conclusion of the contract.

§ 7 Delivery Conditions

(1) Delivery conditions are stated in the respective product listing.
(2) For consumers, risk passes upon handover of goods. For traders, shipping is at their own risk.
(3) As our products are shipped directly from suppliers, delivery times may vary. Estimated delivery times are stated in the product description. The right of withdrawal begins upon actual receipt of the goods, regardless of the delivery time.

§ 8 Governing Law

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) For consumers, this applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of residence.
